Pre-Trial Strategy

We bring the juror’s point of view to the table, helping you tailor your case presentation to make the most of your strengths and overcome your weaknesses.

Witness Preparation

Juror reaction to your witnesses has everything to do with jury reaction to your case, and witness preparation should begin before the first oath is taken by your client or your experts. We work directly with your witnesses to help them communicate effectively with the jury, avoid verbal and visual pitfalls, and prepare for a difficult cross-examination.

Demonstrative Aids Consulting

Because of the way people learn, presenting your case visually is often as important as anything else you do. We know how the decision-making mind works, and we help you design and visually present your case in ways that will help turn that mind in your favor.

Focus Groups

Sooner or later the best thing you can do for your case is talk to people who are like the people who will ultimately decide it. Our focus groups are designed to thoroughly explore the strengths and weaknesses of your case, uncover promising case themes and determine the value of your case through the eyes and ears of jurors.

Mock Trials

Research has shown that nothing predicts damages and trial results as accurately as a mock trial, because no other research model replicates the process with such accuracy and depth. Our mock trials are carefully controlled trial simulations that include case presentations from both sides, demonstrative aids, and expert testimony. Jurors are recruited to demographically match what you are likely to see at trial. Together, we observe and analyze their deliberations via closed-circuit television. When the stakes are high, there is no better way to invest in fine tuning your case before trial.

Juror Questionnaire Development

You cannot alter jurors’ fundamental perspective on your case. That’s why the best thing you can do for your case and for your client is to find those jurors’ whose perspectives are bad for you and get rid of them. We design questionnaires that will show you where your problems on the panel are and provide you with powerful ammunition for getting them excused for cause.

Voir Dire Preparation

Cases can be won or lost in voir dire. We take a rigorous and disciplined approach to the voir dire process. We will work with you to develop a customized strategy for uncovering the juror bias and prejudice most likely to impact the outcome of your case. Then, we’ll be active partners in the courtroom, supporting you as you interview the panel, identify jurors who are a problem for you, and seek to have them eliminated.

Jury Selection

At it’s best, jury selection is a complex task the involves the use of questionnaire data, voir dire responses and selection experience — in a very short amount of time. We help you design and implement a strike strategy that makes the most of these resources and ensures you effectively select favorable jurors and, most importantly, eliminate unfavorable jurors.

Shadow Juries

Our shadow juries keep the juror’s voice front and center even as the trial progresses. We recruit and manage a group of jurors similar to the seated panel, and they provide us with daily opinions as the case unfolds. We help you use their feedback to manage your case presentation to get the results you want.

Post-Trial Interviews

The best feedback you will ever get about your case – and future cases – is from jurors who have actually experienced your case presentation. We do the interviewing for you and report back to you on what worked, what did not work, and what could have made all the difference in your case.

Opening Statement Construction
